§ 1 Scope

FATMOOSE is a brand of Wickey GmbH & Co. KG. The promotion is organised by Wickey GmbH & Co. KG.

§ 1 Scope

These Terms and Conditions apply to participation in the fatmoose Spin and Win promotion. Participation in the fatmoose Spin and Win promotion is governed solely and uniformly by the following Terms and Conditions.

§ 2 Promotion

(1) The promotion is organised by WICKEY GmbH & Co. KG, Franz-Savels-Straße 69, 52538 Gangelt, Germany.

(2) The promotion is available for a limited period. The promotion begins on 09/09/2026 and ends on 28/09/2026 at midnight. Entries submitted after the deadline will not be considered.

(3) Participants may spin the wheel once and can win a 5% Coupon on everything, a 10% Coupon on Basket Value over 750€ and a 15% Coupon on climbing frames over 1000€.

(4) The personalised discount code won is valid until 05/10/2026.

(5) The discount codes cannot be combined with other discount codes, competitions or promotions advertised via social media or Google.

§ 3 Participation

(1) Natural persons with full legal capacity who are at least 18 years old are eligible to participate. Participating customers must have their permanent place of residence in Germany or Austria. Employees of Wickey GmbH & Co. KG and their family members are excluded from participation.

(2) Only customers of Wickey GmbH & Co. KG are eligible to participate.

(3) Participation in the promotion requires a one-time registration by email. To register, the participant must enter their email address in the corresponding field. They will then receive a six-digit code to verify their email address. This code must subsequently be entered in a separate window in the online shop.

(4) Each participant may take part in the promotion once per day.

(5) Wickey GmbH & Co. KG may exclude a participant from the promotion without providing reasons. In particular, it is entitled to do so if the participant has provided incomplete information. In the event of a breach of these Terms and Conditions, or reasonable suspicion of a breach by a participant, Wickey GmbH & Co. KG is entitled to exclude the participant concerned with immediate effect. In such cases, Wickey GmbH & Co. KG is entitled to revoke the prizes and/or, where applicable, demand their return.

§ 4 Procedure and Processing

(1) Cash payment is not possible.

(2) The wheel of fortune may only be spun once.

(3) The discount code won will be sent to the email address previously provided.

§ 5 Participant Data

(1) The participant agrees that, in the event of winning, their name may be used and published by Wickey GmbH & Co. KG for marketing purposes.

(2) The participant expressly agrees that photographs of them may be taken on behalf of Wickey GmbH & Co. KG and published online to promote the promotion. They agree that these photographs, together with the participant's name, may be made publicly accessible for Wickey GmbH & Co. KG's own promotional purposes and may be distributed by Wickey GmbH & Co. KG to the press as part of its press and media coverage of the promotion. The participant's consent also applies to the publication of the photographs and their name in print media and other media. The participant is not entitled to have their name or the photographs taken published. They shall not be entitled to any remuneration arising from the publication of the data and photographs in accordance with this provision.

(3) The participant expressly agrees that Wickey GmbH & Co. KG may store their registration data for the duration of the promotion and, in the event of winning, for the purpose of sending the prize and publishing the information in accordance with paragraph 1.

§ 6 Rights and Obligations of Wickey GmbH & Co. KG

(1) Wickey GmbH & Co. KG does not verify the registration data.

(2) Wickey GmbH & Co. KG is entitled to terminate the promotion at any time. If the promotion is terminated, participants do not need to be informed of the reasons. The promotion may be terminated if its proper execution can no longer be guaranteed for technical or legal reasons. If the termination of the promotion was caused by the conduct of a participant, Wickey GmbH & Co. KG may claim damages.

(3) In the event of a breach of these Terms and Conditions, or reasonable suspicion of a breach by a customer, Wickey GmbH & Co. KG is entitled to exclude the customer concerned.

§ 7 Liability

(1) Wickey GmbH & Co. KG shall have unlimited liability for damage caused intentionally or through gross negligence by Wickey GmbH & Co. KG, its legal representatives, senior employees or ordinary vicarious agents.

(2) Wickey GmbH & Co. KG shall not be liable in cases involving the slightly negligent breach of only non-essential contractual obligations. In all other respects, the liability of Wickey GmbH & Co. KG for damage caused by slight negligence shall be limited to damage that can typically be expected to arise within the scope of the contractual relationship. This also applies to slightly negligent breaches of duty by its legal representatives, senior employees or ordinary vicarious agents. This limitation of liability does not apply to claims arising from physical injury, damage to health or the participant's death, insofar as these are attributable to Wickey GmbH & Co. KG.

(3) All information is provided without guarantee. This applies in particular to the publication of customers' names.

§ 8 Data Protection

(1) Wickey GmbH & Co. KG shall treat participants' registration data confidentially and shall only make it available to third parties insofar as this is permitted under data protection law, necessary for conducting the promotion and sending the discount code, or consented to by the registrant.

(2) Wickey GmbH & Co. KG advises that customers' personal data will be processed electronically. Unless otherwise agreed, the data will be used solely for conducting the promotion and for the promotional purposes specified in § 5.

(3) In the Information on the processing of personal data, Wickey GmbH & Co. KG informs participants about the nature, scope, duration and purpose of the collection, processing and use of personal data, their right to receive information free of charge regarding the personal data stored about them by Wickey GmbH & Co. KG, and their right to have this data corrected, deleted or restricted.

§ 9 Legal Recourse

Legal recourse is excluded.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany shall apply. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law shall apply only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence. The provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply.

(2) If the participant has no general place of jurisdiction in Germany, or if their place of residence or habitual residence is unknown at the time legal proceedings are initiated, the registered office of Wickey GmbH & Co. KG shall be the exclusive place of jurisdiction for all disputes arising from this contract.

(3) Should any individual provision of these Terms and Conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.
